Sources Other than the questionnaire, this report did not use any other sources but analysing a risk matrix of countries whether the profile status was able to be a hub destination or not. Scope This report looks at the opinions of students attending MSIT Mt Gravatt, and investigations of countries in the Pacific and Australasian regions for strategies to conduct major airlines services. Background From this report it will be investigated by the following elements of regional analysis in Australasia and the Pacific. It will also look at the trends from the landscape of aviation analysis and the main key airlines that each countries support on using as its carrier. Demographics will also be analysed by the market performance of the country in each category and its destination ports and statistics. Establishing a performance on its international routes will be the key priority in building successful and stronger platforms for the future.

Becoming An Educator Waking up every morning, excited, motivated and ready to go to school. This is how I felt as a child and now how I want to make other children feel. When I attended school all children loved to be there, but in today's society that isn't the case. So many of the rules in school today have changed. So many issues have arose in today's society like war and violence that students are scared to be at school where they feel unsafe but I , as a future educator would like to change children's outlooks on school. There are many reasons for public schools. The rules however changed tremendously. When you walk into a kindergarten classroom today you see students learning their alphabet, their numbers, playing with others, and coloring pretty pictures. This is what education should consist of. Even though everyone bases everything around learning, it has to include fun to catch the students' attention. Education is so important because without an education you can't proceed in everyday life. When you're young, education is fun and then things get somewhat more difficult as you continue on throughout college. You wonder, is it really worth it, doing all this work just to make a living? Yes it is because if doing all this work can lead you to doing something you love then every minute is worth it. When I walk into a classroom I look at every student and set goals for myself and hope that everyday when I leave that classroom I have taught someone something new that they didn't know before they met me. As a teacher I hope to accomplish achievement in my classroom. I will only set my standards at a high level because that is how I was taught when I was a child, I will not push my students to do more then they think they can. I always remember having a teacher walk into your classroom the first day of school and saying, "I want to be just like that when I grow up." I hope my students can look at me and say that and I also hope they learn something they didn't know before. In my classroom I want my students to enjoy themselves but at the same time I want them to walk out of my classroom with a new perspective.

Classical Civilizations of Ancient Greece, Rome, and China

Throughout history, there have been many civilizations, empires, colonies, and tribes that have impacted the world. The civilizations of Greece, Rome, and China have done this, but what sets them apart from the others is their lasting significance and lasting impact they had on the world. For this reason, they are considered classical civilizations. To describe how Greece, Rome, and Han China are classical, there are three systems that are used; these are Economic, Social, and Political. Out of these three classical civilizations, Greece came first in history.An important invention of Greece was its plumbing systems. Greece was the first to create plumbing and now it is almost unheard of for a house anywhere on earth to not have a plumbing system. This innovation falls under the economic category. The most important social feature from ancient Greeks would be philosophy. After the Peloponnesian Wars, many people began questioning themselves and their beliefs. During this time, many p hilosophers were living in Greece. One of the most important was Socrates. He encouraged people to examine their beliefs.When he was 70, he was taken to trial for â€Å"corrupting the youth of Athens† and â€Å"neglecting the city’s gods. † He was put to death by poison. Some historians say that the fall of Athens started with his death. Plato, one of Socrates’ students, wrote a book about Plato’s vision of a perfectly governed society. Plato’s writings dominated philosophic thought in Europe for almost 1,500 years. Then there was Aristotle, a student of Plato’s. Aristotle invented a method of logic which is the foundation for the scientific method of today.Even Greece’s philosophy was very influential on future civilizations, democracy is considered Greece’s most important contribution to modern society. Democracy, under the political system, is a government controlled by its citizens, either directly or through represe ntatives. Greece was the first to have this type of government. America, along with many other countries, borrowed this idea from Greece when creating their governments. Next on the timeline is Rome. Ancient Rome, like America, borrowed many ideas from the Greeks to create and advance structural ideas.In this way, they adapted their plumbing systems, but improved it by inventing public latrines. We might think of this as an advancement, but Rome had areas where pots were placed in a circle to go to the bathroom, and the waste would drop down into a river or stream (the plumbing system). This was a huge improvement in their sanitary conditions. The Romans acquired other ideas from places other than Greece. In the political division, there was the Roman law where its standards were extremely influenced by the teachings of Stoic philosophers.The principles were based on common sense and practical ideas. Much of modern laws, including the legal systems of many European countries along w ith the United States, have been influenced by the long lasting Roman law. Again with importance, Rome’s agriculture and trade played a big role in Roman life. Agriculture was the most important industry in the empire and everything else depended on it. Most Romans relied on the food grown in their local area and all other food and luxuries were only for the rich and they got them through trade.Rome, being along the Mediterranean Sea, had a enormous trading system and also had roads connecting it to far off places such as Persia and southern Russia. And connecting this huge empire was its sole language, the Latin language. Latin, in the social system, had a major influence on some major languages of the world, including French, Italian, Spanish, and English. Along with Rome’s unified currency know as the Denarius, the Latin language helped unify the civilization by linking diverse people and far away areas.Ancient China’s occurrence overlapped Rome’s, but started afterward, so last would fall China. In comparison with Rome, China had a large trading network. They both built roads to build their networks too. China’s commerce was very important to the Han Empire. When the Empire realized valuable their silk was as an item of trade, they kept their production technique a secret. The demand for silk from China increased. This increase of demand expanded Chinese commerce reaching all the way through Asia and India, all the way to Rome.As trade would fall in the Economic category, China’s bureaucracy and civil service would fall in the Social category. A bureaucracy is a system of departments and agencies that formed o carry out the work of government and a civil service is when people are paid to work within a civilization/country’s government. The bureaucracy of China included eighteen different ranks of civil service jobs that civilians could obtain by taking examinations. But if someone wanted to take one of thes e tests, they would have much more of a chance if they went to the school that Wudi set up.In this school, people studied Confucius’s works. These schools were expensive so only sons of wealthy land owners ever had a chance at a government career. Evidently, you did not have to believe in the Confucianism religion, but those who did were rewarded. Confucianism falls under the social division. These three civilizations were considered classical civilizations because of the impact that Greece, Rome and China had on the modern world’s economic, social and political systems.

The "this" is the elopement of Othello and Desdemona. Roderigo has been giving Iago money to help him into Desdemona's favor, and he assumes that Iago knew about the elopement. Iago didn't know, which must have been embarrassing. Iago tells Roderigo that the elopement was a surprise, and Roderigo replies, "Thou told'st me thou didst hold him in thy hate". Then Iago tells Roderigo about being passed over for promotion. So Iago must have told Roderigo of his hatred for Othello before this, and maybe before he was passed over for promotion. If it was earlier that Iago told Roderigo that he hated Othe llo, that could have been part of Iago's scam, but it also could have been the truth.. After Othello has left for Cyprus, Iago has a soliloquy in which he says that he hates Othello, "And it is thought abroad, that 'twixt my sheets He has done my office". "Abroad" means "everywhere," and Iago's "office" (function) between his sheets is to have sex with his wife. Iago is saying that everyone thinks that Othello is having an affair with Iago's wife. The rest of the play makes it clear that none of this is true; Othello and Iago's wife are not even vaguely intereste...

Dna Fingerprinting Essays - Molecular Biology, Biometrics Dna Fingerprinting DNA Fingerprinting DNA Fingerprinting is also referred to as DNA profiling and DNA typing. It was first developed as an identification technique in England in 1985. The original use was to expose the presence of any genetic diseases. About three years later it became used to identify criminals through the analysis of genetic material and to settle paternity disputes. It is still used for those reasons today. The DNA fingerprinting process is called gel electrophoresis. It is a process that can sort pieces of DNA according to its size. The process is done by taking samples of DNA from the crime scene and comparing it with samples from the accused. Samples are taken from biological materials like blood, semen, hair, and saliva. In the testing process the DNA samples are first entered into the wells in a gel like substance called Agarose. The gel is placed between two electrodes, one negatively charged and the other positively charged. The wells in the Agarose are inserted on the negative side because DNA has a negative charge. Molecules of DNA then travel in lanes toward the positive side. Small molecules will travel farther than the bigger ones, because they have an easier time moving through the gel. So the molecules will then be assorted according to their size. Next, the gel is X-rayed to see the parallel bands (showed by black bars on the film) in each lane. The separated molecules of DNA form a pattern of parallel bands that show the structure of the DNA. The pattern should never change for one person. In a court of law, the results of a DNA fingerprinting examination can be used to convict or acquit an accused person. If the accused's DNA matches the one at the crime scene then that person could be convicted. Critics believe that a DNA fingerprint may not yet be reliable enough to use in the court system. They question how accurate a DNA fingerprint is and the cost of it. They believe that it is not very accurate because only a segment of DNA is used and not the complete strand. A DNA fingerprint may not be unique. The confirmation of the uniqueness has not been confirmed yet. Also the process is done in private laboratories so the exact testing standards may not be followed and standardized quality controls may not be used. Human error can have false results if they do not use the exact testing standards with quality controls. The testing is very expensive and if the accused can't pay for the testing then they will not be able to defend themselves using the results of the test. Also a question is, will people misuse the process? A misuse that scares them is the unauthorized use of the database that will be created with the increasing use of the DNA fingerprint. An example of an unauthori zed use is identifying individuals with a genetic disease by looking up their personal profile without their permission. Once you begin teaching for some time you notice that those initial philosophies change. Writing teaching philosophies are important to teachers because it identifies their thoughts, beliefs, and what they represent in the classroom. Personal Philosophies After thinking and realizing what I stand for in the classroom, I came up with these three philosophies that identify me. I believe that every student is a special education class can learn. Regardless of the child and their disability I believe that every child in a classroom is able to learn. It does not matter how small the progress is just as long as there is progress. I believe that inclusion has both positive and negative aspects on teachers and students. Inclusion allows students to be mainstreamed with peers their age. This gives them a chance to be around students their age as well as learn new things. Sometimes inclusion causes special services student to act out. This happens because they are not familiar with the information and they act out so they will not be embarrassed because their lack of knowledge. Finally, I believe that one-on-one time with special education students is valuable. Working with students individually helps them a lot. I do agree that teachers should keep students aware of the political and social issues that are going on. That is important so that students are aware of the current events. I think that this philosophy is important. It is important for student to know how to handle certain situations that deals with the economy and government. When students enter the real world they should have some knowledge of the government and how it works. They should be familiar with what goes on so that they are able to handle certain situations when they are older. Voting is one of these things they should be familiar with and the procedures in order to be registered to vote. This philosophy is one that I will adopt or add to one I already have. Conclusion Having a personal philosophy is very important. As a special education teacher I think it is important to have more than one. Each year I teach I either amend my philosophies each year or add a new one. The more I teach the more things I begin to believe in. Influence of Personality on Success The present paper attempts to examine the inherent connection between personality and success. The term personality is derived from Latin word persona, a mask worn by actors in classical dramas. Behaviorist psychologists feel that if a person has some kind of impact or makes a certain impression on others, it must be because of his actions. The simplest meaning of personality, therefore, is the pattern of responses which characterizes the individual. An individuals personality is invariably revealed through interactions in the personal, social and the professional arena, for the act of communication determines how one views and in return is viewed by the world around. In the modern world of professional rivalry and competitive business, obsessed with power and achievement, personality becomes the byword for success. There are qualities that enable one to evolve and grow into an empowered and well-balanced personality, a choice that proves to be a wise investment for long-term achieve ments. Such qualities along with the ability to effectively communicate and interact have become much sought after, with everyone trying to understand how one may acquire them. So much so that soft skills and personality development have become the new slogans for professional and career advancement. The paper examines a few such skills and also how one may cultivate them. The paper also takes a look at whether these should be/can be acquired merely for material success or else, these constitute an inherent part of a certain way of living having roots in time-tested and acknowledged cultural practices that leads one to peace, harmony and happiness. Contrary to the general idea that good personality refers to good physical features or trendy looks, personality includes many other important behavioral and mental features. Take the example of Mahatma Gandhi. Most people did not find him to be attractive or impressive as far as his physical make up was concerned. Yet, this short, meek looking, bald, dhoti clad old looking man moved and inspired the entire nation to stand up and demand freedom. Even today he is known for his Personality which established everlasting impression on the people around him and made him the man of fame and world. There have been many others too, relatively recently being Barack Obama, the President of America, who electrified Americans, captured their imagination, inspired million viewers with his twenty minutes speech at the stage of 2004 Democratic National Convention. He, with his outstanding soft skills and emotional intelligence not only transcended race and historic barriers, but also conveyed his vision, inspired confidence, persuaded and motivated people and became Americas first African American President. Thus what makes the difference is the understanding of what is commonly called, the soft skills. Soft skills are essentially people skills the non-technical, intangible, personality-specific skills that determine ones strengths as a leader, speaker, listener, negotiator, and conflict mediator. It means skills related to human attitude, team work, leadership qualities, over all human nature enhancements. Soft skills thus is a sociological term relating to a persons EQ (Emotional Intelligence Quotient), the cluster of personality traits, social graces, communication, language, personal habits, friendliness, and optimism that characterize relationships with other people. They are, in many instances, complementary, and serve to unlock the potential for highly effective performance in people qualified with the requisite hard skills. In broader terms soft skills is a range of abilities including work ethics, courtesy, teamwork, self-discipline and self-confidence, professional presence, language proficiency, cultural sensitivity, communication skills, ability to accept and learn from criticism, ability to handle client relationships, networking, creativity, ability to motivate yourself and lead others, time management, leadership and interpersonal skills. Studies have shown that personality measures parameters like conscientiousness, dependability and agreeability and they are equally important predictors of work success as cognitive ability and work accuracy. These parameters or traits can yield significant return on investment for an organization. For this reason, soft skills are increasingly sought out by employers in addition to standard qualifications. The wide rivers of culture, language and environment can only be crossed with being proficient with soft skills. Also, today Indian companies are facing inten se competition from MNCs who are offering identical services in their own backyard. The only way that Indian companies can continue to dominate this space is by up-skilling their employees in soft skills. Importance of Soft Skills There is an axiom in business circles which suggests hard skills will get a person an interview, but soft skills will land that person a job. Thus, an applicant with years of education and experience in the field might have the hard skills necessary to fill the position, but lack of soft skills such as leadership ability or self-motivation will not allow one to accomplish the task in the desired manner. Research in many fields such as sales and marketing, software development, engineering and law, has shown that to be successful in the workplace, knowledge alone is not enough. Soft skills play a vital role in dealings with the external world and help us to work in a collaborative manner with our colleagues. Studies by Stanford Research Institute and the Carnegie Mellon Foundation among Fortune 500 CEOs found that 75% of long term job success depended on people skills and only 25% on technical skills. This is true at other levels as well. For effective performance in the workplace, companies need their employees to have not only domain knowledge, technical and analytical skills, but also the skills to deal with the clients, customers, vendors and to work in a collaborative manner with their colleagues. We manage and think with our head. ­Ãƒâ€šÃ‚ ­ Service learning, Critical thinking, problem solving, decision making are related to our thinking processes, which we manage with our mind. ­ Functions of the heart are related to people and caring. We relate to people by accepting differences, adopting conflict resolutions, putting into practice social skills, showing cooperation and keeping the channels of communication open. The second function we perform with our heart is caring. We care through nurturing relationships, sharing, empathizing and displaying genuine concern for others. This all constitutes Soft Skills. Indiana Business Research Center (IBRC) has found that, while credentialing in the form of degrees and certificates is important, development of soft skills-skills that are more social than technical-are a crucial part of fostering a dynamic workforce. Skills projected to be in the highest demand include active listening, critical thinking, speaking, active learning, writing, time management, and social perceptiveness. Hence, one must focus on learning and putting into practice various soft skills. The Important soft skills and the ways one may perfect them are: 1 Positive Attitude We have all heard that its better to see the glass half full instead of half empty. And in the workplace, that type of positive thinking can go a long way. A person who focuses on the brighter side of things is definitely much sought after as compared to a fellow who wallows in negativity. An overall positive outlook leads to a positive attitude and that can be a valuable asset in work environments that typically breed cynicism and negativity. The key to having a winning attitude is readiness to face and tackle obstacles and challenges that come our way. For example, instead of complaining about a stressful workload, one may think about it as an opportunity to show off ones abilities and getting through it productively and efficiently. Shiv Khera rightly puts it, Stick to the fight when youre the hardest hit (68). 2. Effective Communication Skills. Effective communication skills help in transforming a manager into an efficient leader. It includes both oral as well as written forms: oral skills for public speaking, presentations, negotiating, conflict resolutions, knowledge-sharing; writing skills for preparing reports, proposals, instruction manuals, writing memos, notices, official correspondence etc. As English for Indians is a second language, so for good communication skills, constant practice at home/school/college followed by language-lab sessions is need of the hour. While good oral skills inspire and motivate employees and win over customers, the written communication helps in following it up at front and back office jobs, clinching deals and ensuring retention of valued employees and prized customers. 3. Confidence and Self-efficacy In almost every situation where one is trying to impress others, confidence is the key. While its important to accept our limitations and act humble when we receive praise, its also important to acknowledge our strengths and embrace them. If one acts confident in some of ones job responsibilities like at written communication, project management skills or leadership abilities, one must make sure that it is based on genuine, positive reinforcement. Confidence comes from preparation, which is nothing but planning and practice. According to Albert Bandura, self-efficacy is the belief in ones capabilities to organize and execute the courses of action required for managing prospective situations (1977; 2). Thus self-efficacy is a persons belief in his or her ability to succeed in a particular situation. In other words it is confidence that Bandura believes can be developed in leaders and employees for specific tasks in given situations. Confidence is not only open to development, but the more confident the individual, The more likely the choice will be made to really get into the task and welcome the challenge. The more effort and motivation will be given to successfully accomplish the task; and The more persistence there will be when obstacles are encountered or even when there is initial failure (2000; 42). This profile of a highly confident leader or employee seems ideal for effectiveness and high-performance in todays workplace. In addition to performance outcomes, confidence has been shown to positively affect goal aspirations and attainment. This strength and positive attitude has also been shown to have an impact on strategy formulation, entrepreneurial start-ups and managing very difficult situations. 4. Creative Skills Creativity and imaginative thinking are valued in any job. Even the most technical positions require the ability to think outside the box. Whenever handed a tedious task, one should try to tackle it in a way that allows it to be completed more efficiently. When a problem comes along that others are reluctant to take on, the one who dares to jump at the opportunity to find a creative solution is the ideal performer. 5. Accept and learn from criticism This is one of the most challenging soft skills, which is why it is typically one of the most impressive to employers. Our ability to handle criticism says a lot about our willingness to improve. At the same time, being able to criticize the work of others in a constructive way is just as important. It requires enormous maturity to be aware of how defensive one gets when confronted by negative feedback and how not to reject a piece of constructive criticism completely without acknowledging that at least part of it is helpful. Hence how to offer criticism in a diplomatic manner is an important skill to work at. 6. Motivate yourself and lead others It is important for an employer to know what type of person his employee is. If one is a self-starter who takes initiative, such an individual must be given space to carry out his/her activities. This means constantly seeking out new ways to keep the job interesting and motivational, even if at the surface it seems repetitive and mundane. Creativity plays a big role in this, but theres more to motivation than just that. It requires courage to pursue ideas one has had stuck in the back of the mind, and dedication to follow through with them and be successful. The important skill to work at is to be able to nudge others in the same direction to work towards a common goal. If you want to climb the echelons of success, you should show a personality with strong leadership skills. One must always remember that a good leader leads by example. Proactive Being proactive means thinking and acting ahead. Basically, this means using foresight. It is a great method for avoiding more work down the road and for averting disasters. By planning well for the future and instituting systems at work, makes life easier not just for oneself, but for others as well. This can be done by following some procedures: Try to prevent problems from ever arising. This means tackling possible failings in advance to prevent them from becoming a reality. Feeling pride in ones job and having a sense of accomplishment are necessary ingredients of a well-balanced personality. 9. Interpersonal and Teamwork Skills Interpersonal and teamwork skills contribute to higher productivity and better environment as people work together to reach common goals. Some individuals are born leaders or intuitively adopt the traits required in team work. However, in general, these skills need to be taught or can be learnt through practice and awareness. As leader or as member of a team, a worker at times has to handle interpersonal conflicts, personality clashes and other issues related to the team. One should be able to analyze the differences in various persons in the team and take impartial decisions. For this a motivational leader is required who inspires a team to new levels of innovation and productivity by working with the following dimensions: Assertiveness is the quality necessary to learn so that one is able to get the point across in a forceful manner and show others that one will not back down. If the leader does not then he/she will get run over and ideas which are probably good will be thrown righ t out of the window. One must be able to persuade others to get the job done in a timely manner and also in an efficient one. Persuasion is a nice and more gentle way to motivate than assertiveness, but since there will be diversity within the group, we must understand that everyone is motivated in different ways. Work without ethics will not give a long life to organizations as well as individuals. In order to possess the above discussed skills one needs to be self-aware and cultivate positivism in thought and approach. Common sense What is lacking among most people is common sense. People are good in repeating what others do or what the boss says. Many people fail to think on their own and take appropriate decisions at the time of crisis. The solutions to many of the problems are related to basic facts and minimum efforts. But people think much and work less towards the solutions. People at the managerial level are expected to have the knowledge of basic facts, simple solutions and common sense. To understand any social value or goal is important to get the pulse of a certain society but standing alone tell us nothing about law and public policy outcomes, so the central question resides on institutional choice. The Forest Act

INTRODUCTION the term forest is defined as an area of land with at least ten per cent (10%) of tree crown cover, naturally grown or planted and/or fifty per cent (50%) or more shrub and tree regeneration cover and includes all forest reserves of whatever kind declared or gazetted under this Act and all plantations. The Forest Ordinance of 1959, is the law which governs the Forest Law of 2002, having the objective to effect governmental control for economic gain rather than sustainable development, as the concept of environment is not been taken seriously.HISTORICAL BACKGROUND OF FORESTS IN TANZANIA Historically the forest act can be traced back as far as 1819 to 1919 whereby the state controlled forest estate was initially established under German colonial administration who were the first colonialist in Tanzania. The German’s administrator used different methods and tactics in preserving the forest such as forcing the residences near forest or in the forest places to evacuate d those places immediately and there were no remedies present for those who violated the decree intentionally.In 1921 after the Second World War Tanganyika was placed to the British Administration. The English supervision presented the Forest Ordinance which was based on that used in adjacent Kenya colony which placed restriction on access to and use of forest products. The spirit of the British colonialists to protect the forest and its resources were also seen in the Land Ordinance whereby it introduced protected areas; forests areas being part and parcel.Soon after independence, forests in Tanzania have been managed and controlled by the Forest and Beekeeping Division under the Ministry of Natural Resources and Tourism. This management has been characterized by extensive state control which does not involve the local community forests. The forest management was due to forest degradation and deforestation through illegal activities and increase of human pressure on natural resourc es. In Tanzania a vast forest area existed for instance in the 1990’s, the forested areas were ranging from 41-42 percent.It was observed that most of the forested areas were cleared for agricultural, overgrazing, wildfires, charcoal burning and overexploitation activities. During 1961-1997 it was discovered that over 10 million hectares of forest had been lost therefore in order to prevent this loss the Ministry of Natural Resources and Tourism made an effort and concentrated on active participation of the local community and stake holders. In 1990 the Forest Policy came into existence by virtue of the Forest and Beekeeping Division.Currently the Forest sector in Tanzania is controlled by three parallel structures which includes The Ministry of Natural Resources and Tourism, The Regional Secretariat and the Local Authority. NATIONAL FOREST POLICY, 1998 The Forest Policy (NFP) of 1998 in Tanzania was the result of reviewing its Forest Policy of 1953. Generally, the objective of this policy was to enhance the contribution of Forest sector to the sustainable development in Tanzania and conservation and management of her natural resources for the benefit of the present and the future generation.This means that forests have to be managed in terms of socio-economic, ecological and cultural sustainability and with the principle of multi-functionality and equitable benefit and responsibility sharing. Also the Forest Policy also recognizes the role of the private sector in management of forest resources and the policy responsibility of managing forest resources will be left in the hands of specialized agencies and the private sector, central government responsibility will be managed.The Policy promotes tools to implement different communities based management regimes, ranking from Joint Forest Management to community management (Community Based Forest Management, Village Forest Reserve). The objectives related to forest policy OTo ensure sustainable development and equitable use of resources for meeting the basic needs of present and future generation without degrading the environment or risking health or safety. OTo present and control degradation of land, water, vegetation and air which constitute our life support systems.OTo conserve and enhance our natural and man-made heritage, including the biological diversity of the unique ecosystem of Tanzania. OTo improve the condition and productivity of the degraded areas including rural and urban settlement in order that all Tanzanians may live in safe, healthy, productive and aesthetical pleasing surroundings. OTo raise public awareness and understanding of the essential linkages between environment and to promote individual and community participation in environmental action.OTo promote international cooperation on the environment agenda, and expand our participation and contribution to relevant bilateral, sub-regional, regional and global organizations and programs, including implementatio n of conventions. OTHER OBJECTIVES The National forest policy is based on macro-economic, environment framework and social framework. In microeconomic framework has the objective, which lifts the national economy and facilitate wholesome growth, the policy has stated the following objectives: OTo combat poverty and deprivation in order to improve people’s path.OTo ensure macro-economic stability. OTo create an enabling environment for a strong private sector. O To reduce government involvement in direct productive activities. OTo improve efficiency in the use of public resources. FOREST ACT, 2002 The objectives of the Forest Act, 2002 as analyzed under the provision of Part II of the Act are: OTo promote, to enhance the contribution of the forest sector to the sustainable development of Tanzania and the conservation and management of natural resources for the benefit of present and future generations.OTo encourage and facilitate the active participation of the citizen in the sustainable planning, management, use and conservation of forest resources through the development of individual and community rights, whether derived from customary law or under this Act, to use and manage forest resources; OTo ensure ecosystem stability through conservation of forest biodiversity, water catchments and soil fertility; OTo delegate responsibility for management of forest resources to the lowest possible level of local management consistent with the furtherance of national policies; OTo ensure the sustainable supply of forest products and ervices by maintaining sufficient forest area under efficient, effective and economical management; OTo enhance the quality and improve the marketability of forest products and regulate their export; OTo promote coordination and cooperation between the forest sector and other agencies and bodies in the public and private sectors in respect of the management of the natural resources of Tanzania; OTo facilitate greater public awarenes s of the cultural, economic and social benefits for conserving and increasing sustainable forest cover by developing programmes in training, research and public education; OTo enable Tanzania to pay, fully in contributing towards and benefiting from international efforts and measures to protect and enhance global bio-diversity.The Act enables the State to fulfill its obligation to meet the standards determined by international instruments to enhance and protect global bio-diversity. Section 5 provides for ministerial responsibility and function of the director, where as Section 6 provides for the appointment and function of the officer. ADMINISTRATION AND INSTITUTIONAL MECHANISM OF THE FOREST ACT, 2002. THE INSTITUTIONS MECHANISM ESTABLISHED UNDER THE FOREST ACT, there are three major institutions created by the Forest Act, which are, the forestry advisory committee, Community forest management group for managing forest reserves, and Tanzania forest fund. NATIONAL FORESTRY ADVISORY COMMITTEEThis is a committee established under Section 10 of the Act, and the minister appoints the committee members, who function to advise the minister on; OMatters relating to issuance of concession and conditions as provided for under Section 20(11) of this Act; OMatters relating to declaration of a forest reserve as provided under Section 23(6) of this Act; OMatters relating to the management of forest reserve as provided under Section 27(5) of this Act; review of the forest policy; and OAny other matter, which the Minister may specify. COMMUNITY FOREST MANAGEMENT GROUPS Community Forest management group may be formed by any group of persons who are members of a village living in or near to a forest or group of persons who are managing a forest or part thereof or who are desirous of managing a forest reserve or part thereof. TANZANIA FOREST FUNDThis is another institution established under the Act, which deals with financial matter, in which the funds and its resources consist of fee payable, royalty payable, grants donations and bequests, any sum realizes by the sale of forest produce and income generated by any project financed by the fund, and such funds are managed by forest fund trustee appointed by the minister. The object and purpose of the fund is to meet the objectives of the Act as analyzed in the provision of Section 3. ADMINISTRATION MECHANISMS Part III of the Forest Act provides for administrative and institutional mechanisms. To start with administration, the Act provides that there is a Minister responsible for forest matters and that the Minister is responsible for policy formulation and for ensuring execution by official in the ministry such functions connected with the implementation of this Act.Apart from that, there is a Director of the forestry who is appointed by the President and bears the function of advising the government on all matters of management of the forests. On top of that the Director is required and empowered by the Ac t to make a determination affecting or likely to affect the rights of any individuals and give reasons for the decisions. There are other Appointed Officers who have the duty to ensure the efficient, effective and economical management and supervisions of forests as directed by the Act. These officers appointed by the Director include, licensing and registration officers, enforcement officers, inspectors and all of them are answerable to the director. Furthermore, there exists a Local Authority and Forest Management Authority.Power to designate any person to be an Authorized Officer has been vested to the Director and he also has power to delegate to such public officers, a local authority officer to perform any work imposed on him by the Act. CREATION OF FOREST RESERVE The Act provides for the creation of forests reserves as analyzed under section 4, which include national forest reserves, local authority forest reserves, village forest and private forest. The Act goes further in p roviding for the guiding procedures in declaring an area to be a forest reserve under Section 23, and provision of compensation in case of claims arising out of an area, which is declared a forest reserve is provided under Section 24(1) PERMITS AND LICENSESUnder Part VI provides for specified activities to be carried in national or local authority forest reserve subject to conditions as prescribed in the permit, which is sought in respect of Section 50, and grant of permit, variation and modification of the same is provided for under Section 53, Section(s) 54 and 55, provide for Surrender of permit and Revocation or suspension of the permit. ENVIRONMENTAL PRINCIPLES UNDER THE FOREST ACT GENERAL PRINCIPLES ORight to information, meaning that the director and all officers are required to ensure that members of the public are equally and adequately given information and guidance in connection to implementation of this Act ORight to appeal, any individual aggrieved by a decision under t his Act has a right to appeal in the High court SPECIFIC PRINCIPLESOPrinciple of local level governance, meaning that the right and duties of which villagers have to respect village land reserves and function of local authority in respect of village land forest reserve OPrinciple of prevention action, restriction on boundary vegetation, inspection of forest produce by experts, prohibition of marking by unknown persons, prohibition of export of forest produce without certification OPrinciple of restrictive measures, the Act provides for the restriction in the creation of new rights for forest reserves, were as subsection 5 of section 25, an investigation process can be allowed to enquire in a matter that has been reported to the minister or chief executive officer.OPrinciple of sustainable development, which ensures the ecosystem stability through conservation of the forest biodiversity, water catchments and soil fertility and facilitating public awareness so as to increase sustainab le forest cover by developing training programmes and education, as well as sustainability in connection to harvest of forest products. OPrinciple of inter-generational equity, the Act encourages and facilitate active participation of the citizens in the sustainable planning of the environment and forest reserves through community out reach OThe Act further looks at the concept of Environmental Impact Assessment, and the provision binds both the public and private local authorities . OFFENCES AND PENALTIES The Act also provides for various offences and penalties in general. These offences have been provided for under part XI, Section 84-100.Section 84 generally provides offense relating to forest reserve which includes entrance into the forest reserve, performing any act contrary to section 26, obstruct roads path or water course, damage forest reserve, grazing of livestock shall be guilt of an offence upon conviction liable to a fine not less than thirty thousands (Tshs) and not ex ceeding one million or to imprisonment for a term not exceeding two years or to both such fine and imprisonment. Section 85 offences relating trees not in forest reserve. A person may be held liable for the following action felling trees, cuts trees, loops damage, remove or sell any reserved tree or any party thereof unreserved land shall be guilty of an offence and upon conviction shall be liable to a fine of not less than fifty thousands (Tshs) or imprisonment not exceeding one year or to both such fine and imprisonment.Section 86 relating to wild plants, any person without lawfully authority picks pluck takes sample any part or any way or by any way interferes with or willfully and intentionally poison damage or destroy in any way wild plants or expose for sell or purchase export or attempt to expose shall be guilt of an offence and upon conviction shall be liable to a fine not less than two hundred thousand (Tshs) and not exceeding one million shilling or to imprisonment for a t erm not less than six months and not exceeding two years or to both. Section 90 provides for counterfeiting and similar offences, any person who counterfeiting alters obliterates or defaces any stamp mark, sign, license permit, certificate authority or receipt used or issued under this act shall be guilty of an offence and upon conviction shall be liable to a fine not less than one million shilling and not exceeding three million or to imprisonment for not less one year and not exceeding two years or both. Section 91 on offences in connection with fires.Any person who without lawful authority lights or assists in lighting or uses rekindles or adds fuels or any fire or causes any of theses to fake place leaves an attended fires before such fire is thoroughly extinguished or fails to comply with lawfully order issued to him under and in connection with any of the provisions of part 9 of this act shall be guilt of an offence and upon conviction shall be liable to affine not less than f ifty thousands(Tshs) or not exceeding one million or to imprisonment not exceeding one year or both. Where any person is convicted of an offence against this act the Court may in addition to any other penalty provided for in this Act order cancellation of the permit for period that a forest reserve manager may see fit and upon damage of forest produce will pay compensation for the same subject to ten times the amount of royalties or fees which had the action constituting the offence. STRENGTHS OF THE FOREST ACTThe Act links the central government and the local community in the whole process of preservation and protection of the forest resources in order to ensure national development and this is done through public participation in decision making in forest management as portrayed under Section 42 through the Participatory Forest Management(PFM) and the Community Base Forest Management(CBFM) which involves village and local people of forest protection. also, the Act provides for Pri vate forests in which individuals who are the holders of the right of occupancy enter into covenants on land that without previous consent of the Director. The Act also establish the administration and institutional machinery in order to protect forest resources.Also it provides for Minister responsible for forest and Director of Forest Officers who are appointees of the Director and Forest Advisory Committee and the National Plants Protection Advisory Committee. The Act provides for participation of local communities in the management of their lands and, their rights on natural resources are clearly recognized as per Section 14, 32 and 40 of the Forest Act No. 14, 2002 which provides for village land forest management plans and rights and duties of villages in respect of village land forest reserve. never the less, the Act provides for trade on forest produce through establishing procedures necessary to conduct forests trade and forest produce.This led to ensure sustainable trade o f forest produce and forest conservation and a person need to have trade permit and license of conducting trade as stipulated under the Act. Moreover, the establishment of the Tanzania Forest Fund. The fund contributes towards on the conservation of the forest resources and the main purpose is to promote awareness and to ensure development and sustainable use of forest resources through public education and training and to promote the community forestry in the whole process of development through making grants and providing advice and assistance to group of persons. WEAKNESSES OF THE ACT There are some conflicts between the Forest Act and the Village Land Act regarding the procedures for the establishment of Village Forest Reserve.Section 32(2) and 33 of the Village Land Act provide for procedures such as application to the village council, signed by the party applying for the derivative right or his duly appointed agent or representative; accompanied by simple plan showing the loca tion and boundaries of the land and any other information which may be prescribed or which may be required by the village council, accompanied by any fees which may be prescribed; notified to the members of the village by any means of publicity which will bring the matter to their attention; whereas the Forest Act provide for concepts like private forests which includes forestry dedication covenants, application for concession, use of land as private forest land and concession. Also concepts such as forest reserves other than village and community forest reserve, village land forest reserves and community forest reserves which all provide for various procedures for each where in village land act it provides for the general procedures.Section 98 0f the Act provide that no matter or thing done by any authorized officer to perform any function under the Act, shall, if done in good faith in execution or purported execution of his function under this Act, render him personally liable for the matter or thing concerned. This means that the act did not provide protection to an individual member of the society rather it’s only the official who is protected. Also same section of the same act provide that any person is liable for any offence against the act but do not provide the meaning of any person and that makes authorities to become people who will be liable for any offence which will have unnecessary immunity. The director of the forestry has been vested with so much power which can make him abuse the power.Section 5(2) to (4) provide that director of the forest is appointed by the president whom will become an officer of public service, the director is to advise the government on all matters of management of forests and also to give reason to the person who is affected by the decisions of the director. Then if the director is the one to advice the government on matters relating to the forest then can give decisions which will be more favorable to the author ities and desire of the government regardless of what is really needed in forest development. The Forest Act empowered only the high court to have jurisdiction over the matters pertaining forest protection. ith the high court having the powers itself then there are some situations which people who affected by the acts done to the forest fail to submit their complaints to the court since they have no access to it. In Tanzania most regions have only one court; for instance in Iringa all district like Mafinga and Mufindi depends on the high court which is at Iringa municipal; With this regards then access to justice fails. CONCLUSION AND RECOMENDATIONS it is our recommendation that the law to relating to protection of the forest be modified so as to fit with the corent society were there defforestation of the lands is of great extend all over the world and Tanzania in Particular by imposing heavier punishment to those who harm the forests for the benefit of the current and coming gener ation.
